Tripitsu Terms of Service

Important Notice

Please read these Terms of Service carefully. By booking, paying for, participating in, or using any tour, itinerary, travel service, consultation, custom travel planning service, transfer, add-on, or related offering provided by Tripitsu USA, LLC ("Tripitsu," "we," "us," or "our"), including services offered through Tripitsu.com, you agree to be bound by these Terms of Service (the "Terms"). These Terms form a binding agreement between you and Tripitsu USA, LLC.

If you make a Booking on behalf of another traveler or multiple travelers, you represent and warrant that you have authority to accept these Terms on behalf of each traveler on the Booking and that each traveler has agreed to be bound by them.

You must be at least 18 years old to make a Booking. No traveler under 4 years of age may participate in any Trip unless Tripitsu expressly offers and confirms such Trip in writing, which Tripitsu is under no obligation to do.

Tripitsu.com is owned and operated by Tripitsu USA, LLC and is hosted using Shopify. Your use of the Tripitsu website is also subject to any applicable Shopify platform terms and conditions to the extent relevant to website functionality, payments, checkout operations, and related services, but in the event of any conflict regarding the travel services sold by Tripitsu, these Terms govern the relationship between you and Tripitsu.

1. Definitions

For purposes of these Terms:

  • "Booking" means any reservation for a Trip, service, add-on, or related product made with Tripitsu.

  • "Trip" means any tour, package, itinerary, private or custom trip, day service, transfer, excursion, consultation, or travel-related service sold, arranged, coordinated, or operated by Tripitsu.

  • "Traveler," "you," or "your" means each person named on a Booking.

  • "Primary Booker" means the person who makes a Booking on behalf of themselves or others.

  • "Suppliers" means third-party providers of travel products and services, including but not limited to hotels, transport operators, drivers, guides, local destination partners, activity operators, restaurants, insurers, and other providers.

  • "Departure Date" means the first scheduled date on which booked travel services begin.

  • "Transfer Credit" means the portion of amounts paid that Tripitsu permits, in its sole discretion and subject to these Terms, to be applied to a future eligible Booking under Section 10.

  • "Booking Fee" means the non-refundable administrative and reservation fee described in Section 7.

  • "Force Majeure Event" means any event beyond Tripitsu’s reasonable control, including but not limited to natural disasters, severe weather, flooding, fires, wildfires, earthquakes, volcanic activity, epidemics, pandemics, war, invasion, hostilities, terrorist acts or threats, civil unrest, riots, strikes, labor disruptions, government orders, border closures, curfews, transportation shutdowns, supplier insolvency, infrastructure failures, public health emergencies, or any other event making travel unsafe, illegal, impracticable, commercially unreasonable, or impossible.

  • "Child" means a traveler who is under the age of 18 at the time of travel but at least 4 years old.

2. The Booking Contract

A Booking is confirmed, and a contract is formed, only when Tripitsu issues written confirmation and full payment has been successfully received and processed.

Bookings are not permitted within forty-five (45) days of the Departure Date under any circumstances.

Tripitsu requires full payment at the time of Booking unless Tripitsu expressly agrees otherwise in writing. A Booking is not secured, held, or guaranteed until such payment has been fully processed.

You are responsible for reviewing your Booking confirmation promptly and notifying Tripitsu immediately of any errors, omissions, or discrepancies. Names must match each traveler’s government-issued identification and passport exactly, where applicable. Tripitsu is not responsible for fees, losses, denied boarding, denied entry, lost reservations, or other consequences resulting from inaccurate information supplied by you.

3. Booking on Behalf of Others

If you make a Booking for one or more other travelers, you are the Primary Booker and are responsible for:

  • providing complete, current, and accurate information for all travelers;

  • making all required payments when due;

  • receiving and communicating all Tripitsu notices, updates, changes, deadlines, and documents to all travelers on the Booking;

  • ensuring that all travelers understand and agree to these Terms and any additional waivers or supplemental terms applicable to the Trip; and

  • confirming that all travelers meet the age, health, mobility, insurance, and documentation requirements applicable to the Trip.

Tripitsu may rely on instructions, approvals, authorizations, and representations from the Primary Booker for the entire Booking unless Tripitsu expressly agrees otherwise in writing.

4. Prices, Quotes, Currency, and Inclusions

All prices are stated in the currency shown at checkout or on the applicable invoice, which will generally be USD, and are inclusive of applicable sales taxes and VAT unless expressly stated otherwise.

Pricing is not per person. Pricing is based on the group composition selected at the time of Booking and is limited to the following permitted group structures for each Booking:

  • 1 Adult

  • 2 Adults

  • 3 Adults

  • 4 Adults

  • 1 Adult + 1 Child

  • 1 Adult + 2 Children

  • 1 Adult + 3 Children

  • 2 Adults + 1 Child

  • 2 Adults + 2 Children

  • 3 Adults + 1 Child

Each Booking may include only one such group, with a maximum of 4 travelers per Booking. Simultaneous Bookings of up to 5 groups are permitted, for a maximum combined total of 20 travelers, provided that the adult-to-child ratio does not exceed 1 Adult to 3 Children within any permitted group structure.

No traveler under age 4 may participate in any Trip unless Tripitsu expressly offers and confirms such Trip in writing, which Tripitsu is under no obligation to do.

Unless expressly stated otherwise, Trip prices include only those items specifically listed as included in the itinerary, Booking confirmation, or Trip description.

Unless specifically stated as included, Trip prices do NOT include:

  • international or domestic airfare or other travel to or from Sri Lanka;

  • airport transfers outside the services expressly included in the itinerary;

  • passport, visa, entry, exit, transit, or travel authorization fees;

  • vaccinations, medical tests, prescriptions, health documentation, or medical clearances;

  • travel insurance or related premiums;

  • gratuities;

  • optional activities and personal purchases;

  • baggage fees;

  • meals and beverages not expressly listed as included;

  • laundry, telephone, internet, minibar, room service, and other incidental charges; or

  • items of a personal nature.

Tripitsu’s services are generally land-based services in Sri Lanka. Unless explicitly included in writing, travelers are solely responsible for arranging and paying for transportation to Sri Lanka and from Sri Lanka.

Quotes are subject to availability and are not guaranteed until Booking is confirmed and payment is received.

5. Errors, Omissions, and Pricing Corrections

Tripitsu reserves the right to correct any pricing, typographical, calculation, system, content, or human errors at any time before or after Booking confirmation.

If a correction materially affects your Booking price or a material aspect of the services purchased, Tripitsu will notify you and provide available options, which may include:

  • acceptance of the corrected Booking;

  • transfer to an available alternative Trip or service; or

  • cancellation with refund of amounts paid to Tripitsu if Tripitsu is unable or unwilling to honor the Booking as originally presented.

Tripitsu is not required to honor manifest errors, obvious pricing errors, or system malfunctions.

6. Payment Terms

Tripitsu requires full payment at the time of Booking unless Tripitsu expressly agrees otherwise in writing.

A Booking is not secured until full payment is received and processed.

Tripitsu may accept payment by payment methods made available during checkout or invoicing. Card processing fees are built into Trip pricing at the time of Booking; however, all third-party processing fees remain non-refundable under all circumstances, including cancellations, reversals, disputes, or chargebacks.

You are responsible for any bank fees, wire fees, payment-related fees, and any foreign exchange or currency conversion costs. Foreign exchange fluctuations are the traveler’s responsibility when paying with a non-USD payment method or card.

If any payment is reversed, declined, disputed, charged back, or otherwise not honored, Tripitsu may cancel the Booking and apply all otherwise applicable cancellation terms. Tripitsu also reserves the right to recover any unpaid balances, chargeback fees, collection costs, reasonable attorneys’ fees, and other amounts resulting from payment disputes or reversals.

7. Non-Refundable Booking Fee

Because Tripitsu incurs administrative, planning, reservation, supplier, and coordination costs immediately upon confirmation, each Booking includes a non-refundable Booking Fee of US$250 per person.

The Booking Fee is separate from and in addition to any third-party processing fees, and third-party processing fees are not included in the Booking Fee.

The Booking Fee is never refundable once the Booking is confirmed. Subject to the cancellation schedule in Section 10, the Booking Fee may, in certain circumstances and only to the extent expressly permitted by Tripitsu, be transferable as Transfer Credit toward another eligible Booking, but it has no cash value.

8. Required Traveler Information

As a condition of travel, you must provide all information reasonably requested by Tripitsu by the deadlines Tripitsu specifies. This may include:

  • full legal name as shown on passport or government-issued identification;

  • date of birth;

  • nationality and passport details;

  • emergency contact information;

  • dietary restrictions and food allergies;

  • medical, mobility, accessibility, or health information relevant to safe participation;

  • travel insurance policy details and supporting documents;

  • signed waivers, acknowledgments, releases, or declarations required by Tripitsu or its Suppliers; and

  • any additional forms or information reasonably requested for Trip operations, accommodations, transport, or activities.

If you fail to provide required information by the stated deadline, Tripitsu may treat the Booking as canceled by you, and all applicable cancellation charges will apply.

9. Travel Documents, Entry Requirements, and Health Requirements

You are solely responsible for obtaining and carrying all valid passports, visas, permits, vaccination records, health certificates, travel authorizations, and any other documentation required for travel, transit, entry, exit, or participation in a Trip.

Tripitsu does not guarantee entry into any country or access to any flight, transport service, hotel, activity, or destination. Tripitsu does not provide legal, immigration, or consular advice.

Denied boarding, denied entry, travel disruption, or inability to participate resulting from your failure to obtain proper documentation, meet entry requirements, or comply with government or airline rules is your responsibility and is treated as a traveler cancellation.

You are also responsible for checking and satisfying all current health, vaccination, and destination-entry requirements applicable to your travel.

10. Cancellation by Traveler; Refund and Transfer Policy

You may cancel your Booking only by providing written notice to Tripitsu. Cancellation becomes effective when Tripitsu actually receives your written notice.

Unless otherwise stated in writing for a specific Trip, Tripitsu’s cancellation, refund, and transfer policy is based on the number of calendar days before the Departure Date that Tripitsu receives your cancellation notice.

All cancellation percentages below apply to the total Booking price. All cancellation outcomes are in addition to non-refundable third-party processing fees, which are never refundable under any circumstances.

For clarity:

  • “Non-refundable” means not eligible for any cash refund under any circumstance.

  • “Transferable” means eligible only for issuance as Transfer Credit, subject to all limitations in this Section.

A. 180 or more days before departure

  • Refundable: All amounts paid except:

    • the US$250 per person Booking Fee, and

    • all non-refundable third-party processing fees.

    • Transferable: The US$250 per person Booking Fee may be applied as Transfer Credit toward another eligible Booking.

B. 179 to 90 days before departure

  • Non-refundable (cash): 50% of the total Booking price, plus all third-party processing fees.

  • Transferable: Up to 100% of the amount paid may be issued as Transfer Credit.

C. 89 to 45 days before departure

  • Non-refundable (cash): 100% of the total Booking price, plus all third-party processing fees.

  • Transferable: The full amount paid may be transferred as Transfer Credit minus a rebooking fee of US$250 per person.

D. 44 to 1 days before departure

Due to supplier commitments, prepaid accommodations, transportation arrangements, permits, staffing, and operational costs incurred within this period:

  • Non-refundable and non-transferable: 85% of the total Booking price, plus all third-party processing fees.

  • Transferable: The remaining 15% of the total Booking price may be issued as Transfer Credit.

E. Day of departure, no-show, or early termination

  • Non-refundable: 100% of the total Booking price.

  • Non-transferable: 100% of the total Booking price.

No refunds or credits will be issued for any unused services, missed departures, or voluntary termination of travel.

F. Additional Rules Applicable to All Cancellations and Transfers

1. Transfer Credit Conditions

Any Transfer Credit issued:

  • has no cash value and cannot be redeemed for cash;

  • is valid for 2 years from the date of cancellation, provided Tripitsu continues to operate and offer applicable Trips;

  • may only be used toward a new Booking for Trips offered by Tripitsu at the time of redemption;

  • may not be used for physical goods, merchandise, or non-travel services;

  • may be transferred to another individual, but never to any person under 18 years of age at the time of transfer;

  • may not be resold, auctioned, or transferred for commercial gain;

  • is subject to Tripitsu’s then-current pricing, availability, itinerary structure, and Terms of Service;

  • may require additional payment if the new Trip price exceeds the Transfer Credit value;

  • may not be combined with promotions, discounts, or special offers unless expressly approved in writing by Tripitsu;

  • may not be split across multiple Bookings unless expressly approved in writing by Tripitsu;

  • may not be applied retroactively to any existing or previously confirmed Booking.

2. Supplier Limitations

Transferability is not guaranteed and is always subject to Supplier rules, restrictions, and contractual obligations.

Where Supplier terms make transfer impossible, restricted, unlawful, or commercially impracticable, Transfer Credit will be limited to the amounts actually recoverable and permitted to be credited by the relevant Suppliers, if any.

3. Refund Method and Deductions

Refunds, where applicable, will be issued to the original payment method unless Tripitsu determines that an alternative method is necessary or more practical.

All refunds will exclude:

  • the non-refundable Booking Fee (where applicable);

  • all third-party processing fees;

  • any unrecoverable Supplier costs;

  • any bank, wire, or foreign exchange costs incurred; and

  • any amounts designated as non-refundable under these Terms.

4. Third-Party Costs

Airfare, visa fees, insurance premiums, independently booked accommodations, optional activities, and other third-party costs are refundable only if and to the extent Tripitsu actually receives a refund from the relevant provider and is legally permitted to pass that refund through.

5. No Exceptions; Discretion

These cancellation terms are strictly enforced.

No exceptions will be made except at the sole discretion of Tripitsu, and any exception granted in one instance does not create a precedent or obligation to grant similar exceptions in the future.

6. Chargeback Acknowledgment

By completing a Booking, you acknowledge that you have read, understood, and agreed to this cancellation and refund policy.

You agree not to initiate chargebacks or payment disputes based solely on disagreement with these Terms, including the application of cancellation fees, non-refundable amounts, or Transfer Credit policies.

7. Insurance Recommendation

Tripitsu requires that you obtain comprehensive travel insurance that includes cancellation and interruption coverage sufficient to cover the total Booking price, as these cancellation terms are strict and will be enforced. See Section 16.

11. Booking Changes Requested by Traveler

Any requested change to dates, itinerary, traveler name, rooming, accommodations, group composition, inclusions, or other Booking details is subject to availability, Supplier rules, repricing, and Tripitsu approval.

Tripitsu may charge:

  • the US$250 per person rebooking fee where applicable under Section 10;

  • additional administrative fees;

  • any increased Trip price resulting from repricing;

  • any penalties, change fees, or additional costs imposed by Suppliers; and

  • any taxes or governmental charges applicable to the modified arrangement.

Some requested changes may be treated by Tripitsu as cancellation and rebooking, in which case Section 10 applies in full.

Name changes may not be permitted where Supplier rules prohibit them.

12. Cancellation or Changes by Tripitsu Before Departure

Tripitsu reserves the right to cancel, postpone, substitute, suspend, reroute, or modify a Trip before departure for operational, safety, commercial, legal, or Force Majeure reasons.

If Tripitsu cancels a Trip before departure for reasons other than a Force Majeure Event, Tripitsu will offer one of the following, at Tripitsu’s discretion and subject to availability:

  • a comparable replacement Trip;

  • a credit toward a future Booking; or

  • a refund of amounts paid to Tripitsu for the affected Trip.

If Tripitsu cancels or materially changes a Trip before departure due to a Force Majeure Event, Tripitsu may offer:

  • a comparable replacement Trip;

  • a Transfer Credit or future travel credit; or

  • a refund less unrecoverable costs and amounts paid or committed to Suppliers.

To the fullest extent permitted by law, Tripitsu is not responsible for independently booked arrangements, including but not limited to flights, hotels, visas, insurance, vaccinations, tests, and other services not booked directly through Tripitsu.

If a Supplier provides Tripitsu only with a credit or future-travel value rather than a cash refund, Tripitsu may provide the traveler with a credit or future-travel value in the same or substantially similar form, to the extent permitted by applicable law.

13. Changes After Departure; Flexibility

Adventure and custom travel require flexibility. You acknowledge that routes, schedules, accommodations, vehicles, guides, activities, meal plans, included services, and the order of services may change after departure due to local conditions, weather, safety concerns, governmental restrictions, road conditions, operational needs, Supplier availability, transportation issues, traveler health concerns, or Force Majeure Events.

Where reasonably possible, Tripitsu will use commercially reasonable efforts to provide comparable alternatives.

No refund, compensation, or price reduction is available for:

  • minor changes;

  • substitutions of substantially comparable services;

  • changes made for safety or operational reasons;

  • unused services missed due to your actions, late arrival, illness, refusal to participate, document problems, conduct issues, or voluntary decisions; or

  • delays or disruptions caused by third parties or Force Majeure Events.

14. Force Majeure

Tripitsu is not liable for any failure, delay, cancellation, reduction in services, interruption, or change in itinerary caused in whole or in part by a Force Majeure Event.

Force Majeure Events include, but are not limited to, natural disasters, severe weather, flooding, fires, earthquakes, volcanic events, epidemics, pandemics, public health emergencies, war, threats of war, terrorism, civil unrest, riots, strikes, labor disputes, government actions, border closures, curfews, transportation disruptions, airline interruptions, road closures, utility failures, infrastructure failures, supplier failures, and similar events beyond Tripitsu’s control. This list is illustrative and not exhaustive.

If travel is affected by a Force Majeure Event, Tripitsu may, in its sole discretion and subject to recoveries from Suppliers, provide a substitute Trip, future credit, partial refund, or no refund, depending on the circumstances and the amounts recoverable by Tripitsu.

To the maximum extent permitted by law, Tripitsu is not responsible for any indirect, incidental, special, punitive, consequential, or out-of-pocket losses arising from a Force Majeure Event, including airfare losses, additional accommodations, meals, missed connections, loss of enjoyment, business interruption, or similar losses.

15. Medical Fitness, Special Requirements, and Accessibility

You are responsible for determining whether a Trip is suitable for you in light of your physical fitness, health, mobility, medical condition, risk tolerance, and personal requirements.

You must disclose at the time of Booking any condition, disability, dietary restriction, food allergy, mobility limitation, pregnancy, injury, illness, or other circumstance that may affect your ability to safely participate or may require accommodation.

Tripitsu will make reasonable efforts to communicate requests to Suppliers but cannot guarantee that all needs, accommodations, or preferences can be met, especially in remote destinations or where local infrastructure is limited.

Wheelchairs and similar mobility devices are not permitted unless the Trip is explicitly designated by Tripitsu in writing as “Wheelchair Accessible” at the time of Booking.

Tripitsu may decline or remove a traveler from a Trip, at the traveler’s expense and without refund, if Tripitsu reasonably determines that the traveler:

  • cannot safely participate;

  • requires assistance beyond what Tripitsu or its Suppliers can reasonably provide;

  • has failed to disclose a material health, mobility, or safety issue;

  • lacks the physical capability required for the Trip or a booked activity; or

  • presents a risk to self, others, wildlife, property, or Trip operations.

16. Insurance (Mandatory Requirement)

Travel insurance is mandatory for all travelers and is a strict condition of participation in any Trip offered by Tripitsu.

Insurance is the traveler’s primary financial protection against the cancellation penalties described in Section 10, as well as risks associated with travel, including medical emergencies, evacuation, interruption, and other unforeseen events.

1. Minimum Coverage Requirements

All travelers must obtain a comprehensive travel insurance policy that meets or exceeds the following minimum coverage requirements:

A. Trip Cancellation and Interruption

  • Coverage must equal at least 100% of the total Trip cost at the time of Booking.

  • Must include coverage for cancellation and interruption due to illness, injury, death, and other standard covered reasons.

B. Emergency Medical Coverage

  • Minimum coverage of USD $100,000 per person.

C. Emergency Evacuation and Repatriation

  • Minimum coverage of USD $250,000 per person.

D. Adventure Activity Coverage

  • Policy must explicitly cover adventure and activity-based travel, including but not limited to:

    • wildlife safaris and jeep excursions;

    • boating, kayaking, canoeing, and water-based transport;

    • hiking, trekking, cycling, and similar activities; and

    • travel in remote or rural locations.

E. Additional Recommended Coverage (Strongly Advised)

While not mandatory, Tripitsu strongly recommends that policies also include:

  • baggage loss or delay coverage;

  • travel delay coverage;

  • personal liability coverage.

It is the traveler’s sole responsibility to ensure that their policy meets all required minimums and is appropriate for the Trip.

2. Booking Restrictions and Deadlines

Bookings are not permitted within forty-five (45) days of the Departure Date.

For Bookings made between forty-five (45) and ninety (90) days before Departure:

  • proof of insurance must be submitted within five (5) business days of Booking;

  • one (1) resubmission is permitted if initially rejected;

  • final acceptable proof must be submitted no later than thirty-five (35) days prior to Departure.

3. Review Process

  • Tripitsu will review submitted insurance documentation within forty-eight (48) hours of receipt.

  • No response from Tripitsu within that time period shall constitute acceptance.

4. Enforcement

Failure to provide acceptable proof of insurance within the required timeframe may result in cancellation of the Booking by Tripitsu, and all cancellation penalties under Section 10 shall apply.

5. Ongoing Requirements

  • Insurance coverage must remain valid and active for the entire duration of the Trip.

  • Travelers must carry proof of insurance during travel and be able to present it upon request.

6. Disclaimer of Responsibility

Tripitsu’s review of insurance documentation is administrative only and does not constitute verification, endorsement, or confirmation that coverage is adequate. Travelers are solely responsible for ensuring that their policy meets all requirements and is appropriate for their individual needs.

17. Assumption of Risk; Separate Activity Waivers

Travel, including international, rural, wildlife, water-based, adventure, and developing-destination travel, involves inherent risks. These risks may include illness, injury, death, crime, political instability, transport accidents, wildlife encounters, food- or water-borne illness, remote medical care, weather events, natural disasters, acts or omissions of third parties, and the limitations of local infrastructure and medical response.

Tripitsu’s Trips may involve or include access to activities such as safaris, wildlife viewing, jeep rides, off-road travel, boating, canoeing, kayaking, rafting, jet skiing, hiking, trekking, cycling, mountain biking, and other activities that carry heightened risks. The G Adventures kayaking materials and Globus safari waiver you provided both use separate acknowledgement-and-release language for exactly that reason, and Tripitsu will do the same.

By booking or participating, you acknowledge these risks, accept them voluntarily, and assume responsibility for your own conduct, decisions, and well-being during travel.

Tripitsu may require you to sign a separate participation waiver, assumption-of-risk acknowledgment, release, or activity-specific form for certain Trips or activities. A traveler who refuses to sign a required waiver or acknowledgment may be denied participation in the applicable activity or Trip without refund, and Tripitsu may treat the refusal as a traveler cancellation where appropriate.

18. Supplier Responsibility and Third-Party Services

Tripitsu acts as a tour operator and/or intermediary arranging services with independent Suppliers. Hotels, transport companies, drivers, guides, restaurants, activity operators, insurers, and other Suppliers are independent contractors and are not employees, agents, partners, joint venturers, or controlled affiliates of Tripitsu.

Tripitsu is not liable for the acts, omissions, errors, negligence, insolvency, delays, cancellations, failures, quality issues, service interruptions, or defaults of any independent Supplier, except to the extent liability cannot lawfully be excluded under applicable law.

All transportation, accommodations, activities, and ancillary services are also subject to the terms and conditions of the relevant Supplier, including limitations of liability and operational restrictions.

19. Optional Activities and Third-Party Excursions

Optional activities not specifically included in your Booking may be provided by third parties under separate terms and at your own risk.

Any assistance by Tripitsu staff, representatives, guides, or drivers in identifying, discussing, reserving, or facilitating optional activities is provided only as a convenience and does not make Tripitsu the operator of those activities.

Tripitsu does not own or operate optional activity providers and is not liable for any injury, loss, damage, delay, death, or expense arising from optional activities or third-party excursions.

20. Authority to Refuse or Remove Travelers

Tripitsu and its Suppliers may refuse service, boarding, participation, or continued travel, without refund, if a traveler:

  • violates these Terms or any Trip-specific rules;

  • breaks laws or regulations;

  • behaves in a disruptive, abusive, discriminatory, harassing, threatening, intoxicated, reckless, or unsafe manner;

  • endangers self or others;

  • interferes with guides, drivers, wildlife protocols, or Supplier operations;

  • carries prohibited items, illegal substances, or prohibited weapons; or

  • fails to follow the lawful instructions of Tripitsu staff, guides, drivers, vessel personnel, hotel staff, or Suppliers.

Any resulting costs, including transport, accommodation, damages, fines, medical care, evacuation, repatriation, legal expenses, or replacement arrangements, are your responsibility.

21. Traveler Conduct; Damage; Illegal Substances

You are responsible for your conduct and for all damage, loss, or expense caused by you.

You agree to reimburse Tripitsu or the relevant Supplier for any damage, extraordinary cleaning, repair, replacement, fines, penalties, legal fees, or related costs caused by your acts or omissions.

Smoking and vaping are prohibited in all vehicles and anywhere prohibited by Suppliers, including hotels, restaurants, and activity areas where smoking is restricted.

Illegal drugs, prohibited substances, and prohibited weapons are not permitted on any Trip. Violation may result in immediate removal without refund.

No refund is due for unused services resulting from lateness, illness, misconduct, refusal to comply with rules, missed departures, voluntary absence, or removal from a Trip or activity.

22. Baggage and Personal Property

You are responsible for your baggage and personal property at all times.

Tripitsu is not responsible for loss, theft, delay, destruction, or damage to luggage, electronics, valuables, jewelry, cameras, travel documents, medication, passports, cash, or other personal possessions, except to the extent required by applicable law.

Baggage limits may apply depending on destination, vehicle, accommodation, airline, train, road condition, or activity. You are responsible for complying with all baggage restrictions and for any excess baggage fees or resulting operational issues.

23. Accommodation, Transport, and Itinerary Conditions

Accommodation descriptions, room configurations, bed types, transport modes, amenity descriptions, and travel times are based on information supplied by Suppliers and may change.

Tripitsu does not guarantee:

  • specific hotels, rooms, floors, or views;

  • exact room configurations or bed types;

  • specific drivers, guides, or vehicles;

  • seat assignments;

  • uninterrupted air-conditioning, internet access, utilities, or amenities;

  • exact travel times, traffic conditions, or road conditions; or

  • that every advertised feature will be available at all times.

Substitutions of substantially comparable services may be made when necessary.

24. Photographs, Video, and Marketing Use

Tripitsu will only use a traveler’s image, likeness, voice, photograph, or video recording for marketing, promotional, editorial, website, social media, or other public-facing commercial use if the traveler has provided explicit written opt-in consent.

Tripitsu may provide a separate media consent or release form for that purpose. Absence of such express written opt-in consent means Tripitsu does not have permission to use that traveler’s likeness for those marketing purposes.

Nothing in this Section requires Tripitsu to use any traveler image or media.

25. Privacy and Data Use

Tripitsu collects and uses personal information only as reasonably necessary to process Bookings, arrange travel services, communicate with travelers, comply with legal obligations, support Trip operations, and provide customer service.

Tripitsu will never sell your personal information.

Tripitsu will not disclose your personal information to third parties except:

  • as reasonably necessary to provide the travel services you purchased;

  • to Tripitsu’s contracted Suppliers and service providers involved in delivering the Trip;

  • to payment processors, insurers, government authorities, or legal/regulatory bodies where reasonably necessary or legally required; or

  • as otherwise authorized by you in writing.

Tripitsu’s handling of personal data is also governed by its Privacy Policy, once finalized and published. In the event of conflict between these Terms and the Privacy Policy regarding travel-service operations, these Terms control to the extent permitted by law.

26. Complaints and Claims Procedure

If you have a complaint during a Trip, you must notify Tripitsu or the relevant local representative promptly so Tripitsu has a fair opportunity to address the issue while travel is ongoing.

Any post-travel complaint, claim, or request for compensation must be submitted to Tripitsu in writing within 30 days after the end of the Trip.

Failure to provide prompt notice may reduce or eliminate Tripitsu’s ability to investigate and resolve the issue and may affect any claim to relief to the extent permitted by law.

27. Limitation of Liability

To the fullest extent permitted by law:

  1. Tripitsu is not liable for any indirect, incidental, special, punitive, consequential, or exemplary damages, including loss of enjoyment, emotional distress, loss of business opportunity, loss of profits, missed connections, additional out-of-pocket expenses, or other non-direct damages.

  2. Tripitsu is not liable for the acts, omissions, or defaults of independent Suppliers.

  3. Tripitsu’s total aggregate liability arising out of or relating to a Booking, Trip, or these Terms shall not exceed the amount actually paid by the traveler to Tripitsu for the specific Trip giving rise to the claim, excluding insurance premiums, third-party air services, visa fees, independently booked services, and amounts paid to third parties not retained by Tripitsu.

  4. Where international conventions, carrier conditions, or local laws apply, Tripitsu’s liability is limited to the maximum protections and limitations available under those laws, conventions, and conditions.

Nothing in these Terms is intended to exclude or limit liability to the extent such liability cannot lawfully be excluded or limited.

28. Indemnity

You agree to indemnify, defend, and hold harmless Tripitsu and its officers, owners, members, employees, contractors, representatives, affiliates, and agents from and against any claims, losses, liabilities, damages, costs, expenses, fines, penalties, and reasonable legal fees arising out of or related to:

  • your breach of these Terms;

  • your negligence, misconduct, or unlawful acts;

  • your violation of Supplier rules or governmental regulations;

  • your participation in activities for which you are not fit, qualified, or compliant; or

  • your acts or omissions causing injury, loss, damage, delay, or expense to any person or property.

29. Governing Law; Mandatory Mediation; Binding Arbitration; Class Action Waiver

1. Governing Law

These Terms, any Booking, any Trip, any related services, and any dispute, claim, or controversy arising out of or relating to the foregoing (collectively, “Disputes”) shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict-of-law principles.

2. Mandatory Pre-Dispute Resolution (Mediation Requirement)

Before initiating arbitration, the parties agree to attempt to resolve any Dispute through good-faith mediation.

  • Either party may initiate mediation by providing written notice to the other party describing the nature of the Dispute.

  • The parties shall have 30 days from the date of such notice to attempt to resolve the Dispute through informal discussions or mediation.

  • Mediation may be conducted remotely or in a mutually agreed location.

This mediation requirement is a condition precedent to arbitration. Failure to attempt good-faith mediation may result in a stay or dismissal of arbitration proceedings.

3. Binding Arbitration (Exclusive Remedy)

If a Dispute is not resolved through mediation within the 30-day period, the Dispute shall be resolved exclusively through final and binding arbitration, except as otherwise expressly provided in this Section.

  • Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect.

  • The arbitration shall take place in the State of Wyoming, USA, unless otherwise required by applicable law or mutually agreed by the parties.

  • The arbitrator shall have exclusive authority to resolve all Disputes, including issues relating to the interpretation, applicability, enforceability, or formation of these Terms.

Arbitration under this Section shall be the sole and exclusive method of resolving Disputes, and no Dispute may be brought in court except as expressly permitted below.

4. Class Action and Collective Action Waiver

To the fullest extent permitted by law, all Disputes must be brought on an individual basis only.

You agree that:

  • you will not bring any claim as a plaintiff or class member in any purported class, collective, representative, or mass action;

  • you waive any right to participate in or recover through any class, collective, or representative proceeding; and

  • the arbitrator may not consolidate claims or preside over any form of class or representative proceeding.

5. Jury Trial Waiver

To the fullest extent permitted by law, you and Tripitsu each waive any right to a trial by jury in any proceeding arising out of or relating to these Terms, any Booking, or any Trip.

6. Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual claim in a small claims court of competent jurisdiction, provided that:

  • the claim is brought on an individual basis only; and

  • the claim falls within the jurisdictional limits of that court.

7. Arbitration Costs and Fees

Arbitration fees shall be allocated in accordance with the AAA Consumer Arbitration Rules.

  • Each party shall bear its own legal fees and costs unless otherwise awarded by the arbitrator under applicable law or AAA rules.

  • The arbitrator shall have authority to award costs, fees, or other relief as permitted by law.

8. Exclusive Venue and Jurisdiction

To the fullest extent permitted by law, any arbitration or permitted court proceeding shall occur exclusively in the State of Wyoming, USA, and the parties consent to the personal jurisdiction of such forum.

9. Survival

This Section 29 shall survive:

  • cancellation of any Booking;

  • completion or termination of any Trip;

  • termination of these Terms; and

  • any dispute arising thereafter.

30. Time Limit for Claims

Any claim against Tripitsu must be brought within one (1) year after the later of:

  • the end date of the Trip; or

  • the date on which the claim arose,

except where a shorter or longer period is required by applicable law.

31. Severability

If any provision of these Terms is held unenforceable, invalid, or unlawful, that provision shall be interpreted as narrowly as necessary to make it enforceable where possible, and the remainder of the Terms shall remain in full force and effect.

32. Entire Agreement

These Terms, together with your Booking confirmation, itinerary, invoice, waivers, insurance requirements, media consent forms, activity releases, and any specific written supplemental terms provided by Tripitsu for a particular Trip, constitute the entire agreement between you and Tripitsu and supersede prior discussions, representations, marketing summaries, or understandings relating to the Booking.

33. Amendments

Tripitsu may update these Terms from time to time by posting an updated version on its website or otherwise providing notice.

The version in effect at the time of Booking will generally govern that Booking unless a change is required by law, is necessary to address safety or operational issues, or is expressly accepted by you.
